Terms of Service — Shopimaster

1. Overview

These Terms of Service ("Terms") govern your use of shopimaster.com and any services provided by Shopimaster ("we", "our", "us"). By accessing our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our site or services.

2. Services

Shopimaster provides the following services:

Shopify store creation, setup, and configuration
Theme development and customisation
Troubleshooting and technical support
Custom Shopify app development (private and public)
Store optimisation (performance, SEO, conversion rate)
SaaS tools for Shopify merchants, including the Theme Detector

The scope, timeline, and cost of any client project are defined in a separate written agreement or project proposal signed by both parties.

3. Agreements and Payment

All client engagements are project-based. A project begins only after both parties have agreed in writing to the scope, deliverables, and pricing. Payment terms are specified in the individual project agreement.

Unless otherwise agreed, a deposit is required before work commences. Final deliverables are released upon receipt of full payment.

We reserve the right to pause or terminate a project if payment obligations are not met.

4. Intellectual Property

Upon receipt of full payment, the client owns all custom code and design work created specifically for their project. We retain ownership of any pre-existing frameworks, libraries, or tools we bring to the project.

Shopimaster-branded SaaS tools (such as Theme Detector) remain the sole property of Shopimaster. Clients and users are granted a non-exclusive licence to use these tools for their intended purpose.

5. Client Responsibilities

Clients are responsible for:

Providing accurate information and timely feedback during the project.
Ensuring they have the rights to any content, images, or materials supplied to us.
Maintaining their own Shopify account and complying with Shopify's terms of service.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Shopimaster shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including but not limited to loss of revenue, data, or business opportunities.

Our total liability for any claim related to our services shall not exceed the total fees paid by the client for the specific project giving rise to the claim.

7. No Warranty

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that our services will be error-free, uninterrupted, or meet every specific business requirement.

8. Free Tools

Free tools on our website (such as Theme Detector) are provided without warranty and for informational purposes only. Results are based on publicly available storefront data and may not be fully accurate. We reserve the right to modify or discontinue free tools at any time without notice.

9. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes will be subject to the jurisdiction of the courts in the country where Shopimaster operates.

10. Changes to These Terms

We may update these Terms at any time. Changes take effect upon posting to this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
